Terms of Service

getohdit

Please read these Terms carefully. By accessing or using getohdit's services, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These Terms constitute a binding agreement governed by South African law.

1.Definitions

  • “getohdit” / “we” / “us” - getohdit, a product of Akkord (Pty) Ltd, a private company incorporated under South African law (Enterprise Number 2026/467847/07).
  • “Service” - the digital risk and compliance assessment platform at getohdit.co.za, including all assessments, reports, and related deliverables.
  • “Client” / “you” - the individual or entity that purchases, accesses, or uses the Service.
  • “Assessment” - the automated evaluation of a submitted website URL across our pillars (Discovery, LPC conduct compliance, POPIA, Security, SEO, and AI Readiness).
  • “Report” - the written output of an Assessment delivered in PDF or digital format.
  • “CPA” - Consumer Protection Act 68 of 2008.
  • “POPIA” - Protection of Personal Information Act 4 of 2013.
  • “ECTA” - Electronic Communications and Transactions Act 25 of 2002.

2.Nature of the Service

getohdit provides an automated digital risk and compliance assessment service. Assessments are produced by automated AI-powered pipelines and are provided for informational purposes only.

Important limitations:

  • Our Assessments do not constitute legal advice, legal opinions, or legal professional privilege.
  • Our Assessments do not constitute a formal compliance audit or assurance engagement as defined by any professional body.
  • getohdit is not a law firm, auditor, information security firm, or regulated financial services provider.
  • Report findings are indicative and should be verified by appropriately qualified professionals before being relied upon for regulatory decisions.

Nothing in our Reports creates a professional-client relationship, legal advisory relationship, or fiduciary duty.

3.Eligibility and Authorisation

By using our Service, you represent and warrant that:

  • You are at least 18 years of age and have legal capacity to contract under South African law.
  • If acting on behalf of an entity, you are authorised to bind that entity to these Terms.
  • The website URL you submit is your property, or you have the lawful written authority of the website owner to submit it for assessment.
  • All information you provide is accurate and complete.

4.Electronic Consent and Authorisation

Before an Assessment commences, you will sign an electronic consent form. By doing so, you:

  • Authorise getohdit to access, retrieve, and analyse the submitted website URL and its publicly accessible content.
  • Confirm ownership or written authorisation to submit the website for assessment.
  • Acknowledge that automated browser sessions may be performed on the website as part of the Security and POPIA pillars.
  • Acknowledge that AI language models may process website content as part of the Assessment.

Your electronic signature constitutes a valid and binding signature under ECTA Section 13.

5.Payment Terms

Payment is processed through Yoco, a registered South African payment service provider. By completing payment, you authorise the charge of the applicable fee.

  • All prices are quoted in South African Rand (ZAR). getohdit is not currently a registered VAT vendor under the Value Added Tax Act 89 of 1991, and no VAT is charged on the fees quoted. Should getohdit become liable to register, prices will be updated and the position confirmed at checkout before purchase.
  • Payment is required in full before an Assessment commences.
  • An invoice is issued within 24 hours of confirmed payment. Where getohdit is a registered VAT vendor, that invoice will be a tax invoice compliant with Section 20 of the Value Added Tax Act 89 of 1991.
  • getohdit does not store payment card details - all card data is handled exclusively by Yoco.

6.Refund and Cancellation Policy

In accordance with the Consumer Protection Act 68 of 2008:

  • Completed assessments: Once a Report has been delivered, the service has been fully rendered. No refund is available.
  • Assessment not yet started: If cancelled before our pipeline has commenced, you are entitled to a full refund. Contact support@getohdit.co.za within 24 hours of payment.
  • Technical failure: If we cannot complete an Assessment due to a fault on our side, you will receive a full refund or complimentary re-run.
  • CPA cooling-off (direct marketing only): Where your purchase was made as a direct result of unsolicited direct marketing by getohdit (e.g. a cold email or direct approach), you have a right to cancel within 5 business days under CPA Section 16. This right does not apply to purchases made through self-initiated website sign-up. Cancellation requests must be submitted in writing to support@getohdit.co.za.

7.Intellectual Property

Our property: All intellectual property in the Service - including methodology, algorithms, Report templates, software, trade marks, and the getohdit brand - is owned by or licensed to getohdit. These Terms do not transfer any IP rights to you.

Your Report: Upon full payment, getohdit grants you a non-exclusive, non-transferable licence to use your delivered Report for internal business purposes and sharing with professional advisors, partners, and clients for legitimate compliance purposes.

Restrictions: You may not resell, sub-licence, publish, or commercially reproduce the Report, or use it to train AI models, without our prior written consent.

8.Limitation of Liability

To the maximum extent permitted by applicable South African law (including the CPA):

  • getohdit's total liability shall not exceed the fees paid by you for the specific Assessment giving rise to the claim. By accepting these Terms, you specifically acknowledge and agree to this limitation (CPA Section 49).
  • getohdit is not liable for indirect, consequential, or punitive damages, including regulatory penalties, loss of revenue, or reputational harm arising from reliance on an Assessment. By accepting these Terms, you specifically acknowledge and agree to this limitation (CPA Section 49).
  • getohdit does not warrant that Assessments are exhaustive, error-free, or that acting on findings will achieve full regulatory compliance. Report findings are indicative observations only and must be verified by a qualified professional before being relied upon for regulatory decisions.

Nothing in these Terms limits or excludes any liability that cannot lawfully be excluded or limited under South African law, including under the CPA. In particular, these Terms do not exclude liability for: gross negligence; fraud or wilful misconduct; death or personal injury caused by our negligence; or any other liability that Section 51 of the CPA renders void if excluded.

9.Consumer Rights (CPA)

If you are a consumer under the CPA, you have rights including:

  • Right to plain and understandable language (Section 22)
  • Right to fair, reasonable, and just contract terms (Section 48)
  • Right to demand safe, good quality services (Section 54)
  • Right to accurate and complete service information (Section 23)
  • Right to cancel within 5 business days of a direct marketing transaction (Section 16)

10.Acceptable Use

You agree not to use the Service to:

  • Assess websites you do not own or are not authorised to assess
  • Circumvent or interfere with any security features of the Service
  • Reverse-engineer or extract our assessment algorithms or underlying data
  • Use the Service in violation of any South African law, including the ECTA and Computer Misuse provisions
  • Commercially resell or redistribute Reports without our written consent

11.Privacy and Data Processing

Processing of your personal information is governed by our Privacy Policy, incorporated into these Terms by reference.

12.Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Disputes will be resolved:

  • Step 1 - Negotiation: Good-faith negotiation within 20 business days of written notice.
  • Step 2 - Mediation: AFSA-administered mediation if negotiation fails.
  • Step 3 - Litigation: South Gauteng High Court or appropriate magistrate's court.

13.Amendments

getohdit may amend these Terms at any time. Material changes will be communicated via email or a prominent website notice at least 14 days before taking effect. Continued use constitutes acceptance.

14.Severability and Entire Agreement

If any provision is invalid or unenforceable, remaining provisions remain in full force. These Terms, our Privacy Policy, and the consent form signed at assessment constitute the entire agreement between you and getohdit.

15.ECTA Supplier Disclosures

With reference to Section 43 of the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), getohdit discloses the following:

  • Full name and legal status: Akkord (Pty) Ltd, a private company incorporated in the Republic of South Africa (Enterprise Number 2026/467847/07), trading as “getohdit”.
  • Physical address: The registered office address of Akkord (Pty) Ltd is on record with the Companies and Intellectual Property Commission (CIPC) under enterprise number 2026/467847/07. Pending publication on this page, it is available on request by email to hello@getohdit.co.za.
  • Address for legal process: Service of legal documents is accepted at the CIPC-registered office address above. Correspondence may also be sent to legal@getohdit.co.za, but email is not a substitute for service at that address.

  • Main characteristics of the service: Automated AI-powered digital risk and compliance assessment delivered as a written report - see Section 2 above.
  • Full price: Confirmed at checkout in ZAR - see Section 5 above.
  • Terms of payment: Full payment in advance via Yoco - see Section 5 above.
  • Cancellation rights: See Section 6 above.
  • Regulatory membership: getohdit is not a member of a statutory professional or self-regulatory body for the purposes of ECTA.

Before payment is completed, you will have the opportunity to review the transaction, correct any mistakes, and withdraw from it before finally placing your order (ECTA Section 43(2)). A confirmation of your transaction will be sent to your registered email address within a reasonable time of purchase, and is the record of the transaction you can access and retain (ECTA Section 43(1)(m)).
