Akkord (Pty) Ltd t/a getohdit

Purpose: This manual is published in terms of Section 51 of the Promotion of Access to Information Act 2 of 2000 (“PAIA”). It explains what records Akkord (Pty) Ltd holds and how to request access to them.

2.Information Officer

Under PAIA, the head of a private body is responsible for dealing with requests. For Akkord (Pty) Ltd this is the company's director, whose particulars are held on public record by the Companies and Intellectual Property Commission (CIPC) under registration number 2026/467847/07.

3.The Information Regulator's Guide

4.Records Available Without a Formal Request

The following are published on our website and may be accessed freely, without a PAIA request:

If you are a client, the reports and consent records relating to your own assessments are provided to you directly and do not require a PAIA request.

5.Categories of Records Held

6.Records Held Under Other Legislation

Records are also held in terms of, among others:

  • Companies Act 71 of 2008
  • Protection of Personal Information Act 4 of 2013
  • Tax Administration Act 28 of 2011 and the Income Tax Act 58 of 1962
  • Value-Added Tax Act 89 of 1991 (if and when registered)
  • Consumer Protection Act 68 of 2008
  • Electronic Communications and Transactions Act 25 of 2002

7.How to Request a Record

  1. Complete the prescribed request form published under the PAIA Regulations, available from the Information Regulator's website.
  2. Send the completed form to privacy@getohdit.co.za.
  3. Provide sufficient detail to identify the record and to identify you as the requester, and state the form of access required.
  4. If you are requesting the record in order to exercise or protect a right, state which right and how the record is required for that purpose.
  5. Pay the prescribed request and access fees, where applicable. Fees are those set out in the PAIA Regulations; we will notify you of any amount payable before processing.

We will respond within 30 days of receiving a compliant request. That period may be extended by a further 30 days in the circumstances allowed by PAIA, in which case we will tell you why.

8.Grounds on Which a Request May Be Refused

Access may be refused on the grounds set out in Chapter 4 of Part 3 of PAIA. These include the mandatory protection of:

  • the privacy of a third party who is a natural person;
  • commercial information of a third party, including trade secrets;
  • information supplied in confidence, where disclosure would breach a duty of confidence;
  • the safety of individuals, and the protection of property;
  • records privileged from production in legal proceedings;
  • the commercial information of Akkord (Pty) Ltd itself, including research and trade secrets.

A request that is manifestly frivolous or vexatious, or that would involve a substantial and unreasonable diversion of resources, may also be refused.

9.If Your Request Is Refused

PAIA does not provide for an internal appeal against the decision of a private body. If your request is refused, you may apply to a court with jurisdiction for appropriate relief, or lodge a complaint with the Information Regulator.
